In 2009, the Security Service of Ukraine initiated a criminal investigation on the fact of the crime of genocide in Ukraine in 1932-1933. The investigation was joined by court officials, prosecutors and experts (historians, lawyers, medical experts and demographers). A tremendous work was done, the results of which the Ukrainians had been waiting for more than 50 years. However, in the criminal case materials the experts stated that the investigation should be continued for a thorough examination of all the circumstances of the crime. Nevertheless, the Resolution of the Kyiv Court of Appeal of January 13, 2010 is today a historical act that confirmed the legal qualification of the 1932-1933 Holodomor in Ukraine as a crime of genocide.
To speak about the significance and uniqueness of this criminal case, the Holodomor Memorial Memorial invited a candidate of law sciences, Honored Lawyer of Ukraine Victor Skavronik. As a judge of the Chamber of Criminal Cases of the Kyiv City Court of Appeal, Skavronik pre-trialled the criminal case and pronounced the judgment upon the case, while the President of Ukraine of that time Viktor Yanukovych denied the Holodomor-genocide.
At the end of the trial, the judge commented: "I want to remind, I do not have the right to give any interviews and comments. But I want to draw attention to three points. First, I have read all the materials of the case, and such crimes have not happened before. Second, this criminal case is purely legal. I avoided any political speculation. Third, it seems to me that victims and whole nation have long been waiting for a court decision".
On October 25, 2018, at 14:00 in the Museum's Hall of the Memory, Victor Skavronik will read a lecture "Criminal case on the fact of genocide in Ukraine: peculiarities of the preliminary examination by the Court of Appeal and the problem of objective calculation of the number of victims". The expert will speak about the circumstances of the referral for the preliminary consideration of the criminal case to the Court of Appeal of Kiev. He also will explain the issue of condemnation of Stalin, Molotov, Kaganovich and others.
